Does the Constitution say anything about compensating for errors of the past? I think that comes from an unwritten concept called fairness. If SCOTUS throws out the Voting Rights Act compensation for discrimination I will be disappointed but not surprised. The same goes for compensating native americans for the taking of their land and the genocide that followed it. Fairness and decency says we should. It's the right thing to do, but the Constitution doesn't direct it. IT ALSO DOESN'T SAY WE SHOULDN'T! Is equality measured as a point in time and space or an average over both? The average would be more fair.
