If Trump is immune from prosecution for anything he does while in office because he is president of the country, shouldn’t that same status apply to Modura?
Such an essential, fabulous conversation between two really smart lawyers.
Take issue with Steve on only 2 issues.
Curbing executive power just when a Democrat President needs super powers to begin to undo the damage from this aberration in our country's history. Right, we curb presidential powers when a Democrat holds office but do nothing when a Republican president acts like an authoritarian.
Using "soft" rather than "hard" tools to reform the Supreme Court. Inspector Generals - those same Inspector Generals that the Supreme Court allowed to be removed!!! I think there is such an overwhelming mistrust of the Supreme Court that it can't regain trust if it essentially looks the same. So limit its jurisdiction. Expand its numbers, Term limits. The whole basket of reforms.
I also disagree with Steve that if the Supreme Court were diminished it would be missed. One thing this past year has shown is the depth of the jurisprudence of the lower courts. So no, I'm not sure I would miss SCOTUS.
Yes, too many pre-trial" questions that we can almost be certain that SCOTUS will decide (magically) in Trump's favor. Not ALL lower courts are standing up for the rule of law. Currently they allow State governments (with full SCOTUS approval) to use incorrect math, invalid logic, and even ignore their own State laws. (See https://usareset.net/forum/viewtopic.php?t=19)
For suggestions on getting an honest SCOTUS see https://usareset.net/forum/viewtopic.php?t=20 where a 45 Justice court would be better than 9. Neither term limits nor age would change the current POWER dynamic.
It's a reach (illegal) for Trump to extract Maduro from his home to face charges here. It's especially weird since Trump pardoned Juan Orlando Hernández (ex president of Honduras) who was serving a 45 year sentence for the same thing. It just doesn't make sense.
Trump is completely transactional. Hernandez probably flattered and bribed him while Maduro clearly got on his bad side. It’s all run like Trump is a mob boss. Maduro must have “disrespected” him. And BTW, this is all about oil, not drugs.
It was like mission creep in high-speed fast forward. First it was allegedly drug-smuggling boats, morphing almost instantly to the oil. Reports are that the country's oil industry is in poor shape and a lot of deferred maintenance will have to be performed before it's available. We can only guess who will end up paying for it.

You're cute! If you aren't the FFOTUS you don't get any candy! So says the US Supreme Court, anyway....

Vladeck is THE GUY to talk through constitutional issues and especially SHADOW DOCKET issues before SCOTUS.
Excellent as always with Steve. Let's see more of him. He has his head screwed on right, which is something we need these days.
As usual, you and Steve provide such a useful framework for going forward in this discouraging time. Thank you so much!

A show trial seems like an accurate description. Steve lays it out.
Thank you both
I agree. The SC is not held accountable to us.
Thank you for this conversation! Gives me a little bit of hope on a bleak day.
