"The president claimed there was a “rebellion” against the U.S. government, citing unspecified “incidents of violence and disorder.”

However, the statute specifies that orders issued under it “shall be issued through the governors of the States or, in the case of the District of Columbia, through the commanding general of the National Guard of the District of Columbia.”

In its lawsuit, California alleged that recent anti-ICE protests couldn’t constitute a rebellion and that the Trump administration illegally circumvented Newsom’s authority as commander-in-chief of the California National Guard. The state argued that, at the very least, the statute requires governors to be consulted on calling Guard troops into federal service.

The DOJ, represented by Assistant Attorney General Brett Shumate, argued in the hearing Thursday that the judge should not issue an order because the courts have no authority to review the president’s determination of what an invasion, rebellion or inefficient regular resources are.

The judge seemed alarmed by that argument, saying it seemed antithetical to a democracy and closer to a monarchy.

“How is that different than what a monarchist does? He says certain things, he finds certain things, he does certain things. That’s not where we live,” the judge said. “We live in response to a monarchy.”

"After the judge asked the DOJ whether orders were issued through Newsom, Shumate argued that governors are only “conduits” for the president’s order, meaning they don’t need to be consulted.

"To this, Breyer questioned why lawmakers would even have included governors in the statute if that were the case.

“I’m trying to figure out how something is ‘through’ somebody if in fact you didn’t give it to him,” Breyer said, noting that the record reflects that orders were only sent to military officials.

"Breyer appeared poised to deny California’s request that his order also address Trump’s deployment of 700 Marines to Los Angeles. He recognized the state’s concern that using marines could violate Posse Comitatus but didn’t want to speculate about what the government might do and would rather address a “real” violation."

This has to be the focus of the media. Noem lied and said Padilla didn’t identify himself - which is untrue, you can hear him say who he is - but why does that matter? Noem says if he had only identified himself they would not have thrown him to the ground and handcuffed him and prevented him from speaking. This is the height of fascism. These are brown shirt moments.

FIRE ICE! These people should not be paid by our tax dollars. IMPEACH TRUMP! He is not fit to lead. It is shocking and totalitarian. We are not allowed to speak out against Trump, which Ruth Ben-Ghiat has been warning about since before I heard her speak about it last summer.

Also, they said, over 2000 events are registered covering all 50 states. Also, there are 150 events registered in 17 different countries around the world.

I was in a political book club with people in the UK the other day, and I know the UK has several cities which have No Tyrants events.

No Tyrants and No Fascists in countries that have Kings, so we don't offend our home countries. A rule of Democrats Abroad. I am also in Indivisible Deutschland. It is a branch of Indivisible Abroad.

Still, I will be here in the US and in a No Kings march. We are told there will be National Guard sent here to Chicago.

So the brownshirts have arrested and/or assaulted a union president, a mayor, a judge, a Congressional Staffer, a Representative and now a Senator. Who's next?

It's mostly been brown people they've come after so far but it won't stop there. They're just getting started.

Once Donnie gets to invoke martial law and if they choose to come for you, who among you still wants to pretend their social position will keep them safe? And once Donald has the power, do you truly believe he and his Gang will ever let go?

I believe it’s time for our state senators and other representatives who will and should appear at these events with a minimum of five supporting “representatives” when they exercise their first amendment rights, and to stand their ground when attempted to be treated in a similar manner. If cabinet members will continue to lie to the public, while be protected by an entourage of security, in the home state of these representatives who want to question and openly debate the truth with these protected liars, then show up with your own “detail”, in your own state and stand your ground.

I have watched the Senator speak now on interviews since the incident and he is a class act. Top notch person worried about how other people are being treated if he is being treated this way.

The other senators and other congressman are not showing the amount of anger That is needed. They are upset that it happened, but they are talking about hearings when we all saw it on video. They need to be talking about

-the impeachment of NOEM who has now accosted and abuse 2 congress members,

-and they need to be talking about the FIRING of all of the officers and other people that moved that senator out of the room.

Everyday I am more alarmed by the facists in the WH. Kristi Noem is so inept she can't even handle a question from a United States Senator. That the SS decided to take Padilla down is just ludicrous. Will this be their new response when all the unqualified Secretaries have to answer questions in congress? Defund the SS might be added to my protest sign.

To invoke Joe Biden, that's a bunch of malarkey. It was a stunt. The funny part was that Padilla was out of the news cycle in less than ten hours because of the Israeli attack.
